1.1 These Terms of Use explain how you may use this website www.tomahawkhomes.co.uk and all associated web pages (the Site). The Site is operated by or on behalf of Tomahawk Homes Limited (we, us and our). We are a limited company, registered in England. Our registered company number is 10921395, and our registered office is at Centenary House, Peninsula Park, Rydon Lane, Exeter, Devon, UK, EX2 7XE. 

1.2 You should read these Terms carefully before using the Site. 

1.3 By accessing or using the Site or otherwise indicating your consent, you agree to be bound by these Terms and the documents referred to in them.

1.4 If you do not agree with or accept any of these Terms, you should stop using the Site immediately.

  • 8.1.2 business losses; and 

  • 8.1.3 losses to non-consumers

9. Events beyond our control

 We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.

10. Rights of Third Parties

No one other than a party to these Terms has any right to enforce any of these Terms.

11. Variation

 

These Terms are dated 31 October 2017. No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our updated terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.

12. Disputes

12.1 We will try to resolve any disputes with you quickly and efficiently.

12.2 If you are unhappy with us please contact us as soon as possible.

12.3 These terms shall be governed by English law, except that (if you are a consumer and not a business user) and if you live in Scotland or Northern Ireland, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law. 

12.4 You agree that any dispute between you and us regarding these terms will only be dealt with by the English courts, except that (if you are a consumer and not a business user) and if you live in Scotland or Northern Ireland, you can choose to bring legal proceedings either in your country or in England, but if we bring legal proceedings, we may only do so in your country.

12.5 The European Online Dispute Resolution platform http://ec.europa.eu/consumers/odr/ provides information about alternative dispute resolution which may be of interest and we are required to inform you that you may use it if there is a dispute that cannot be resolved between you and us.

13. General

13.1 If any provision of these terms is found to be unenforceable, all other provisions shall remain unaffected.

13.2 These terms may not be varied except with our express written consent.

13.3 These terms and any document expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of any contract. We are required by law to advise you that contracts may be concluded in the English language only and that no public filing requirements apply.
